On The Perfection Of Personal Security Protection System

Along with the domestic violence gradually becoming the global problem,people began to find the domestic violence did harm to people,families and the society.Foreign countries and districts in order to address this increasingly serious social problems,have introduced laws and regulations relevant to domestic violence.The introduction of the Anti-Domestic Violence Act in China means that our country also follows the international trend and begins to control domestic violence,which has serious social harm,by means of laws.However,before that,China did not have a specific law to control domestic violence,only in the "Marriage Law" domestic violence has been regulated slightly,failing to achieve the purpose of prevention of domestic violence.And the system of personal safety protection as an important means of prevention and control of domestic violence has not a law to complete the provisions in our country.In the Anti-Domestic Violence Act,the personal safety protection system as a separate chapter appears for the first time.But as China's practice of prevention of domestic violence is still in the initial stage,there are still some problems in the specific implementation process.This article is mainly based on the theory,concept,content and function of the personal safety protection system,analyzes the shortcomings of the system in China,and then discusses the improvement of the system referring to the legislation and practice experience in the world.This paper is divided into five parts:The first part provides an overview of the personal safety protection system:including the concept,causes and the content and function of the system.The second part analyzes the current situation and problems of the personal safety protection system in our country,and finds out the shortcomings in the implementation process.The third part takes relevant systems of the United Kingdom,the United States,and Taiwan as the main objects of study,analyzes the success of foreign civil protection order system from legislation to judicial process,providing reference for personal security protection system in our country.The fourth part,combined with the problems of China's personal security protection system and the practical experience of foreign relevant systems,explores the improvement of China's personal safety protection system.The last part is a summary of these points.
