Research On The Level Improvement Of The Grass-roots Administration For Industry And Commerce's Law Enforcement

As China's nearly 40 years of reform and opening up,the level of the grass-roots Administration for Industry and Commerce's law enforcement has been improved significantly.The government by law idea,the legal awareness and the service consciousness of enforcers in the Office of Industry and Commerce Management had been enhanced markedly.The laws,regulations and mechanism adapting to the current market economy regulation system had been set up basiclly.The grass-roots Administration for Industry and Commerce is the front position of the administrative system for Industry and commerce and is the direct executor to establish and maintain the socialist market economic order.Persisting the administration according to law has a real and historical signification to realize the”Equality before the law”.And it can help to boost the legal construction of social democracy,achieve the goal to run state affairs according to law.However,China is still a socialist developing country and the economy is not developed,the socialist market economic system has yet to be improved,the low administration efficiency of the administration for industry and commerce due to the elements of organization:economic and cultural has existed for a long time.The industrial and commercial administration system has some loopholes,industrial and commercial administrative management related laws and regulations are not perfect and the enforcers' s phenomenon of execution for interests and executing the law mechanically and abusing of administrative discretion still exists,which will affect relationship between the party and people.If these problems are not resolved promptly,they will affect the administration and build a socialist country ruled by law and realization of the Chinese dream.Firstly,the paper studies the theoretical and significance of the grass-roots Administration for Industry and Commerce law enforcement;Secondly,related to the current practice of the grass-roots industrial and commercial administration,I taked the Liujiaxia Office of Yongjing Industry and Commerce as a specific object and described briefly its achievement which is in the five aspects of the increase in the development of market players,the market supervision and management,protection of rights and interests of consumers,the brand and trademark administrative enforcement and found the problems of administrative law and analyze the causes of the problems;Finally,I put forward constructive opinions and suggestions which is in the improvement of the administrative law mechanism,sound industrial and commercial laws and regulations construction administration team for administration of China's the grass-roots Administration for Industry and Commerce.
