A Study On The Legal Mechanism Of Trade And Protection Of Endangered Species Of Wild Fauna And Flora In China

Endangered species of wild fauna and flora are the most fragile link in the ecological system and trading is not a negligible effect factor among the threatening factors for endangered species of wild fauna and flora.Under the background of the globalization of environmental problems and the increasing number of international environmental conventions,international environmental conventions such as Convention on International Trade in Endangered Species of Wild Fauna and Flora(hereafter referred as CITES)have shown great results in their fulfillment.Therefore,it is of great significance both home and abroad to study on the domestic legal mechanism of trade and protection of endangered species of wild fauna and flora from the perspective of performing the CITES and to seek the road to advancement.There are different definitions and criteria of legal protection on endangered species of wild fauna and flora in various texts,and CITES has special status among them.The legal mechanism of protection in CITES shows considerable meaning towards China's concerning legal mechanism to solve the problems of legislation and legal enforcement of China's concerning legal mechanism.Besides,U.S,E.U and Hong Kong has advanced experience.This paper comes up with the legislation and legal enforcement of China' s trade and protection of endangered species of wild fauna and flora.This paper tries to seek the legal mechanism and fulfillment of CITES,and there still are problems of the lack of rules and the dilemma of legal enforcement.Thispaper is question-oriented,learns from the advanced experience abroad and proposes the fulfilling mechanism of trade and protection of endangered species of wild fauna and flora.The fulfilling mechanism is as follows.In legislation,we need to integrate the present laws and formulate action plans to ensure the systematical and the coordinating fulfillment.In legal enforcement,we are supposed to adjust the list of endangered species of wild fauna and flora,detail the administration of certificate for export and exit,improve the marking management of endangered species of wild fauna and flora,fix the the ports of certain species,and establish the cooperation system.
