Research On Legislation Of Endangered Wild Animals Utilization Behavior

The utilization of wildlife by human beings has a long history.From economic value,scientific value,ornamental value,medicinal value and other aspects,the utilization of endangered wildlife by human beings has formed an industrial form.These industries also consume a large number of China's endangered wildlife resources,some animals even toward extinction.The protection of endangered wild animals has gradually become the focus of people's attention.How to solve the conflict between the protection and utilization of wild animals has become an urgent problem.Due to the huge industry system of wildlife utilization in China,the economic base determines the superstructure,and the limited resources also make us have to admit that the utilization of wildlife cannot be completely prohibited for the time being.Then the rational use of wild animals rather than abuse becomes the main point of the author's concern.Therefore,the author wants to protect endangered wild animals by improving the utilization behavior of endangered wild animals.With ecological civilization written into the Constitution,the report of the 18 th National Congress of the COMMUNIST Party of China put forward the construction of ecological civilization and green development,and the report of the 19 th National Congress of the Communist Party of China paid more attention to it.The Chinese government has paid enough attention to the abuse of endangered wildlife.China's Wildlife Protection Law was revised in 2016,which stipulated the use of endangered wildlife.There are three systems: the hunting system,the artificial breeding system and the special marking system.Under this background,the author carries on the legislation research to the endangered wildlife utilization behavior.The author first starting from the definition of wildlife,to explore the scope of the law,and then according to the human centralism and non-human centralism application in wildlife conservation to discuss the protection of endangered species of wild animals and the use of the limits of the relationship between the necessity of protecting the conclusion and the use of integral,according to the relationship between the two reasonable use limit range are put forward.And then introduced our country legislation status of endangered wildlife use behavior,including direct interpretation,legislative interpretation system can be used to explain and historical explanation of the wildlife protection act,the terrestrial wildlife conservation implementation regulations and so on to analyze the law laws and regulations to explain,and the research to the real case,the behavior of endangered wildlife in China are put forward to use legislation problems.It includes the legislative defects of the hunting system,the artificial breeding system and the special marking system.After that,according to the normative system of hunting system in New Zealand,the United States and European countries,the progress in artificial breeding in South Korea,and the restriction and use of special identification system in Australia,which are helpful to China's legislative experience,targeted legislative Suggestions are proposed for the improvement of the above three systems.After the improvement,the violators who abuse endangered wildlife will be more severely punished,which is conducive to the protection of endangered wildlife,the construction of ecological civilization,and the implementation of the concept of green development.
