The Research On The Protection Of The Name Of Real Estate

The name of the real estate can reflect the quality,price,location and many other factors of the whole real estate.And it also can play the effect of advertising and promote sales.A catchy real estate name often needs a high level planning and a large sum of money.It is the the result of enterprises which paid for hard working and wisdom.However,in reality,the phenomenon that the name of the real estate is copied or fraudulent used becomes more and more,especially between different cities.In response to this situation,the real estate development enterprises have adopted a lawsuit to defend their rights,but it is ineffective,and some of them even lost suit.As it's not a long time that these problems occur,so the study of them are still in the beginning stage either in theory or in practice.The present status of research doesn't assort with the station of real estate industry in macro economy.In these happened cases of real estate trademark,most of them are about the conflict between trademark right and real estate's name right or geographical name right.Based on the conclusions that had reached,I try to analyze the conflict between trademark right,geographical name right,enterprises' name right and building's name right further and conceive the idea of settling the conflict between building's name and the rest commercial mark.After that,I bring forward some suggestions of how to protect name of buildings under the existing regulations for the enterprises in real estate industry.
