Incomplete property right is with the development of the real estate market,low-income people in the face of high prices the market can not meet their demand for the purchase,because our collective land cannot circulate in the law,some developers use low-cost access to the collective land to build houses and then sell to the collective group of buyers crowd outside the fabric,does not conform to our country about the collective land no transfer provisions,but in fact has already formed the trading relationship,the purchased real estate called incomplete property.The court verdict usually incomplete property transfer transaction is invalid,the verdict is the housing sales contracts invalid,but laws and regulations refer to different blindly that incomplete property right transfer contract is invalid is not able to better safeguard the interests of the purchase of land and protect farmers' income,affect the integrity of the building society and stable market order.Article tenth of the Constitution and policy orientation,the principle of freedom of contract and honesty and the "property law" article 153 rd can make the sale of house property contract legal Kazakhstan has certain feasibility,also in the judicial practice in some cases that small incomplete property sales contracts effective,stable market transaction order.Standard system of the collective land ownership,land use rights and land ownership of the subject remains unchanged,from legal leasehold system in Taiwan area of our country to make rural housing free market transaction circulation,so farmers can enjoy the commercialization of land income,improve the income of farmers on the land and housing.The needs of low-income groups in satisfying at the same time has been legally protected,so as to promote the integration of urban and rural development.
