Incomplete property right house as a continuous years of existing social hot issue,especially in today’s high prices, the government to the real estate market adjustingcontrol is lack of power, and also lack of affordable housing, have attracted a widesocial attention. Under the current land system, the first market of land is controlled bygovernment. Collective land cannot directly enter the land market to transaction,which must first be collected by the state into a state-owned. The appearance ofIncomplete property right house room reflects the rigid demand for housing of urbanresidents, as well as the farmers hungry for land value-added revenue. The emergenceand development of Incomplete property houses has the reasons of social-economicand legal systems. This thesis explores the background of incomplete property righthouse real estate appearance and the reasonable existence, in order to identify theproblem of Incomplete property right house, the key to solve the problem ofIncomplete property right house. The thesis is divided into five chapters, the summaryis as follows:The first chapter introduces the origin and the concepts of Incomplete propertyright house, and the references related data are to analyses the existence status ofIncomplete property right house right, and point out the factors that the existence smallproperty relationship with the high prices and the country’s poor regulation on realestate industry in recent years, moreover to explore the rationality and legitimacy of itsexistence.The second chapter analyze the legal obstacles of the incomplete propertyownership, through analysis the drawbacks of the existing dual land system, the landuse right and collective land use rights system, and arrive at the necessity of establishingthe integrated urban and rural land system,and improving the collective land use rightssystem.The third Chapter analysis the illegal reality weaknesses and the drawbacks ofIncomplete property right house right, in order to draw important conclusions that theexisting house property needs to be handled carefully.The fourth Chapter analysis the legitimacy and the reasonable existence ofIncomplete property right house, in order to arrive at the legitimate conclusion thatIncomplete property right house should be built on top of the collective land. The fifth Chapter explores the superficial treatment of the existing incompleteproperty house, and proposes breaking the dual land system and improves the collectiveland use rights system, so that to completely solve the problem of Incomplete propertyright house.
