The cruise liner was one of the earliest forms of transportation.With the development of economy and technology,more efficient and convenient means of transportation such as high-speed rail,light rail,and aircraft are becoming more and more popular.In order to achieve better development,the cruise industry has to adapt to the trend of the times to achieve self-transformation-to realize the transformation from transportation to transportation and tourism.The cruise has built-in facilities for recreation,entertainment,catering,health,and parlors,offering a variety of cultural performances.At the same time,some cruise ships will also choose to stop at various ports to meet the needs of tourists on shore and make leisure cruises possible and shore tourism combined.China has profoundly recognized the strategic significance of the development of the marine economy for stimulating the country's economic prosperity and consolidating the status of the world's major powers.At the time when the 18th National Congress of the Party was convened,it proposed the implementation of the strategy of "Making a Powerful Ocean"and promote the development of the marine industry.Vigorously developing the marine industry is the key to the 21st century "Maritime Silk Road,and the cruise industry is a part of the marine industry that cannot be ignored.According to the comprehensive forecast of the tourism organization,China will become the largest destination for travel by 2020 and the fourth-largest country in cruise passenger flow output.Although cruise travel has long been a tour of the nobility,cruise travel as a civilian has only recently been recognized as an emerging form of tourism.China's cruise tourism is in its infancy.The statistics of the relevant data of 2015 of the China Yacht Transportation Branch of the China Association for Transportation and Transportation:The tenth port of Dalian,Qingdao,Shanghai,Haikou,Sanya,and the hydrological conditions can accommodate cruise ships.In 2015,the country received a total of 629 cruises and 2,480,454 cruise ship visitors.Although the cruise industry is booming,in the technical areas such as cruise ship manufacturing,home port construction,and supporting facilities supervision,as well as the corresponding cruise travel regulations,the cruise ship manufacturing code also has regulations for the management of cruise ship passengers leaving and entering the country.Contract dispute resolution and other legal norms are and there are many problems that need urgent development and improvement.With the popularization of cruise tourism,there has been a wave of cruise travel in China.The development of cruise tourism,the increase in the number of people,and the special nature of cruise tourism will inevitably lead to an increase in the probability of related disputes.Therefore,research on the distribution of responsibility for cruise contract disputes is extremely urgent.How to resolve disputes quickly and reasonably is a topic we continue to explore.This article studies the civil legal relationship among cruise companies,travel agencies,and tourists to determine the nature of the contract between them,further clarifying the distribution of responsibilities in the event of a contractual dispute,and integrating the judicial practice of cruise travel contract disputes into a cruise travel contract to disputeresolution provides theoretical basis and feasibility guidance.
