Judging from the current situation of our country,China has entered an aging society.With the growing aging of the population in China,the development of the existing old-age security system in China is lagging behind,which has brought much pressure on China's economic,political and cultural aspects.The problem of pension has become the focus of the general concern of the society.The new way to solve the problem of pension is also explored,mainly in the way of housing reverse mortgage,which refers to the old people who have independent property rights houses and have less pension funds.It is a novel old-age model to replace the pension in the way of housing guarantee.In recent years,with the significant improvement of the per capita housing ownership rate,Nanjing,Beijing,Shanghai and other cities have launched a pilot housing reverse mortgage loan.After the implementation of these cities,our country has the essential elements of the implementation of housing reverse mortgage loans basically,but the implementation effect is not ideal and it is still lack of corresponding.Supporting legal system and policy measures also bring obstacles to China's development of the business.Therefore,the construction of reverse mortgage system in China still needs further exploration.This paper studies the legal problems of the reverse mortgage loan system in China:Chapter 1,a summary of the reverse mortgage system.The concept and characteristics of the housing reverse mortgage loan system are elaborated.According to comparing with the traditional housing mortgage loan,the highest mortgage and the three similar concepts of the house for the aged,we can further understand the housing reverse mortgage loan.The second chapter analyzes the reverse mortgage loan system in the United States and the United Kingdom.It is beneficial to the study of the legal problems of reverse mortgage in China,then we can conclude that the government can make solid backing and meet the different needs in different ways,and make the corresponding legal norms to ensure the legitimate rights and interests of the mortgagor as the purpose and the smooth development of the system in our country.The third chapter explains the legal problems of housing reverse mortgage system in China's construction process.First of all,the subject system mainly includes the age of the mortgagor and the choice of the mortgagee.Secondly,the object problem mainly includes the renewal of the right to the use of land,the property right of the economically affordable housing and the circulation of the small property room.Finally,the problem of program recourse is analyzed.The fourth chapter,put forward some suggestions on the construction of the system in our country basing on the analysis of the above,from the definition of the subject,the scope of the object,the rights and obligations of the mortgagor and the mortgagee,the procedure and the responsibility mechanism of the reverse mortgage.
