The Legal Issues Of Housing, Reverse Mortgage System

China has already become an aging society. The ageing of population bring profound influence on the economics, politics and culture. But the old-age security system of our country remains relatively lagging behind. The contradictory between the ageing of population and the insufficiency of social security system is more and more prominent. Seeking for new old-age security system has become current urgent matter. Under this background, the Reverse Mortgage(RM)is introduced to our country, and arouses widespread interest. As a new model of pension with houses , RM releases equity in housing to improve the aged people's living standard by the way of housing guarantee without changing the right of inhabitation. RM has been proved an effective way to solve the problem of aging.This paper attempts from the legal angle to study RM system, firstly analyzes the general principles, revealing the definition, the legal characteristic, the comparison of which is contrast with real estate mortgage and social security system; secondly compares the operation model in US, Canada, UK, Singapore and Russia, and summarizes the enlightment to our country; thirdly analyzes the legal issue and institutional conflict; finally from the angle of legislative pattern, principal and basic system framework, puts forward legislative proposals on RM system of our country.
