A Brife Exploration On Legislation Of China's Personal Data Protection

With the development of big data technology,people have entered the age of big data.More and more data are being mined and analyzed,it is widely used in all walks of life.But in fact,most data are constitute of different personal data,which is relative to personality and property.There have been discussions on the protection of personal data by the Western academia and the legislature for quite some time.However,some legislations have been outdated and the newly conclusions are still inconclusive.Judging from the actual situation in our country,the protection of personal data is fragmented,there is no uniform legislation,and there is no corresponding effective legislation in special industries.Therefore,our country should construct a complete data protection system as soon as possible.This article are divided into the introduction and the body.The introduction includes the purpose,significance,status and methods.The body includes four chapters.The first chapter defines the definition and characteristics of personal data,distinguishes the relationship between personal data,information and privacy,studies the classification of personal data by domestic and foreign academic and legislative circles,and puts forward the opinion of our country's data classification.Finally,the author puts forward the value and significance of personal data protection legislation.The second chapter analyzes the process of legislation of personal data protection in China with time clues,and then analyzes the current legislation distribution in the field of finance,e-commerce and data sharing at the national level,and finally discusses the current legislation of personal data protection in our country Deficiencies.Chapter Three discusses the three models of extraterritorial personal data protection legislation,including a unified legislative model represented by the EU and Germany,a decentralized legislative protection model represented by the United States,and a united legislative model represented by Japan.Out of the basic principles of personal data protection legislation outside the domain.The fourth chapter puts forward the suggestions of perfecting the legislation of personal data protection in our country,clarifying citizens' right of personal data,strictly regulating the rights and obligations of personal data processors,establishing personal data classification and protection system,establishing specialized personal data supervising agencies and perfecting personal data rights relief Mechanism,and put forward data leakage protection mechanism,data commercialization mechanism,data security assessment mechanism and data registration and traceability mechanism.Finally,taking into account the issue of the cost of legislation,some proposed adjustments to the existing special law are proposed.
