Research On My Number System Of Japan

In May 2013,the 183th Congressional Session in Japan passed the Number Law which stipulated that every individual residing in Japan would own a fixed 12-digit number(personal code),also known as my number.Not only Japanese nationals,but also those foreigners living in Japan for a long time will also get resident registration accompanied by"my number" when they handle alien registration procedures.Since January 2016,"my number" has begun to be used in areas such as social security,taxation and disaster response.However,with the constant development of the "my number",there is an gradually increasing tendency for the scope of its use.For example,there is also a gradual introduction of such fields as medicine and banking which are closely related to the life of the people.The impact of "my number" will gradually deepen.The continuous popularization of "my number" facilitates the exercise of government power,in the meanwhile its contradiction with the right of privacy and the protection of personal information has become increasingly prominent.Owing to the short period of the implementation of my number system,research on this system in our country is not very rich at present,which is only scattered in some papers on the system introduced,and lacks comprehensive analysis of its effect and problems.The purpose of this thesis is to analyze the relationship between privacy and personal information protection by comprehensively introducing the relevant provisions of Japan's "the Number Law",and to provide reference for the further improvement of personal information protection in our country by reference to its related system design.In addition to the preface and conclusion,this thesis is divided into five parts:The first part firstly introduces the outline of Japan's my number system,then summarizes the background of the implementation of ID system,and briefly summarizes the general structure of "the Number Law".Finally,how this system affects the exercise of government power is analyzed.The second part introduces the relationship between the"my number" system and the resident registration system.On this basis,it analyzes the constitutional litigation triggered by the resident registration system and provides reference for the improvement of the "my number" system.The third part,starting from the stipulation of Article 13 of Japan Constitution and the legal system of Japan's personal information protection,combined with the relevant jurisprudence,analyzes the complementation and conflict between the system and the protection of privacy and personal information.Because of the fact that there is a large amount of personal information in the "my number",the fourth part analyzes how the law restricts the use of"my number" from four aspects:"enumerated" legal provisions,setting up the personal information protection committee,setting more strict punishment standards and establishing a specific personal information protection evaluation system.It is not the purpose of this thesis to study the foreign system.The fifth part summarizes the system design of Japan's "my number",and analyzes what inspiration we can provide for the improvement of our country's ID card system,privacy and personal information protection.
