| As the Supreme People’s Court released the new policy for commutation and parole process,it is more difficult for a prison to apply for commutation for prisoners,as the policy has tightened qualification,commutation time and interval time of application.This policy has caused some setbacks to prison management,including less motivated prisoners,deceased justice in commutation decisions and a lack of methods for primary level prison officers to manage prisoners.Prison scoring system is an important tool for prison to educate and guide prisoners into righteousness,which is also a fundamental work in prison management.But it has always been difficult to standardize and refine scoring system.Moreover,once the scoring system is poorly executed,the quality of overall prison management is at stake.Therefore,in order to cope with the challenges caused by the new commutation policy,it is crucial that scoring system is taken seriously.Only by doing so,the prison management can be improved and a stable prison environment is guaranteed.This thesis takes prison D in Yunnan as an example,focusing on the execution of scoring system under the new commutation policy.Based on true cases,this thesis studies on the problems occurred during law enforcement in primary level of prison management,especially when dealing with criminals with special punishment,elder criminals and criminals with short sentence.Three problems are revealed in the process of law-enforcement,they are criminal’s lack of motivation,unfair phenomenon during evaluation,lack of methods for primary level prison officers to manage prisoners.By looking into aspects such as regulation level,procedure level and system level,the reasons for these problems are also analyzed.At regulation level,the main problems are the scoring system aren’t standardized and refined,the implementation and supervision is not sufficient and the results are easily influenced by environment.At procedure level,the problems are inversion of the assessment process,the unscientific evaluation and the deviation of the assessment purposes.Finally,at system level,there is an isolated phenomenon in the assessment system,which makes it difficult to combine with various regulatory corrective measures.Moreover,combined with the author’s working practice,some ideas to perfect the scoring system is given,including the elaboration of the assessment project and the establishment of a clear code of conduct.Change the concept of assessment to ensure the fairness of the assessment result.Improve the system of assessment and improve the system of management of primary criminals;Preface examination and review to ensure the correct and accurate assessment of the assessment concept;Improve the assessment platform and introduce the application of information technology.These ideas not only can help improve the implementation of existing system,but also can enrich the system itself to some extent and innovate a new assessment method using information platform.The ultimate goal is to make the existing scoring system focus on prisoner’s mental reformation,evaluate individual prisoner,and become fair and objective.In this way,an assessment mechanism that focuses on prisoner’s mental reformation is built,and the scoring system can be more efficient in motivating prisoners,stabilize prison environment and improve the reformation quality of prisons.These suggestions will also make the scoring system more standardized and refined. |
