Research On The Qualification Of Administrative Law Enforcement Of Public Security Frontier Departments

Under the leadership of public security frontier departments directly under the ministry of public security,ministry of public security border administration is responsible for the specific command,management system,the leadership of the implementation of active service system is deployed in the border areas in the coastal areas of an important law enforcement power.In order to maintain the need of the central government and local authority,the public security frontier department carries out certain administrative enforcement and the duty of handling criminal cases according to the authorization or entrustment of administrative law.Because of the influence of the dual system management,the public security frontier departments have been questioned as administrative law enforcement agents.Some academic views equate the concept of "administrative law enforcement body" with "administrative subject".However,the author thinks that the connotation of"administrative law enforcement body" is more extensive.Through the comparison between the two,this paper clarifies the meaning of "administrative law enforcement subject",which leads to the argument of legality and rationality of the public security frontier department as the subject of administrative law enforcement.Public security border controls from the coastal area public security border controls,land area and the public security frontier law enforcement the practical difficulties and problems faced by the perspective such as public security frontier departments as the main administrative law enforcement in law enforcement and the problems existing in the practice,and from the laws,administrative regulations and departmental rules as well as the disadvantages of the existing system,such as Angle to analyze the cause of the problem.Finally from the top legal design level,the coastal border management,land border management aspects of the legislation technology level and in system construction of public security border enforcement personnel management public security frontier departments to jointly build the path of the administrative law enforcement main body.
