China has long land frontier, and the land frontier traffic, as the economic link between China and the other countries which around us, played a very important role for our frontier economy and the foreign trade. But when our frontier traffic policy has adjust and as well as our country joins the WTO in2001, traditional frontier traffic into the slow development stage and far behind the coastal port trade. For the development of our frontier economy and the relationship between China and other counties around us, there appear some cross-border cooperation areas on frontier, and it build up the mode of foreign trade with traditional frontier traffic.In the coexistence of the traditional frontier traffic and cross-border cooperation areas on frontier, Chinese frontier traffic policy and the trade agreements with neighboring countries built up a series of border trade regulations. But there are still many issues to be resolved about our frontier traffic, include the accord ance between these series of regulation and the international agreement. So it is necessary to sort out on Chinese Frontier Traffic regulations, as well as cross-border cooperation area agreement, in the light of the problems occurred in the border trade to be Studied and resolved.The first part is the define about the frontier traffic. This part through the Chinese legislation about the frontier traffic and the research summarized the concept of the frontier traffic under the new period. And then under the research about the Chinese frontier traffic regulations, analyzes the relevant between Chinese frontier traffic regulations and the international agreement and point out that although the preferential measures in the traditional border trade against WTO rules of the common most-favoured-nation treatment principle but this preferential measures accord with the spirit and purpose of WTO, and some of them had been changed after China join the WTO, so it does not violate the provisions of the WTO. In addition, the first part also summarizes the characteristics of frontier traffic, and analyzes the different between general international trade and the frontier traffic.The second part is the development stages and the model about the frontier traffic in our country. In this part, it summarized the development stages and model about the traditional frontier traffic in our country, then point out that the cross-border cooperation area on frontier is the new progress about the frontier traffic in our country under the trend of trade liberalization. And actually it is extend and new develop about the traditional frontier traffic.The third part is the about the cross-border cooperation area on frontier in our country and the agreement about the cross-border cooperation area on frontier in our country. In this part, it takes take the China-Kazakhstan international frontier cooperation center in Horgos as example which is typical representative of the cross-border cooperation area on frontier to analyzes the station, the character and the problem. And after contrast the connection between the international frontier cooperation center in Horgos agreement and relevant international agreement, point out that such cross-border cooperation areas on our frontier are accord with the principles about international agreement, and the cross-border cooperation area on frontier will stay at the free trade area stage in a long time under the trend of trade liberalization.The fourth part is about the domination and the dispute in cross-border cooperation area on frontier. This part is based on the framework agreement of the People’s Republic of China and the Republic of Kazakhstan government on the establishment of "international border cooperation center in Horgos" and the agreement of the People’s Republic of China and the Republic of Kazakhstan government about the management of activities in international border cooperation center in Horgos and the practice by the two countries in Horgos center, it analysis the legislative power, the judicial power and the administrative power. And when it is come to the dispute which in economic cross-border cooperation center, we should have a all-around and developmental vision, and take the win-win results as the purpose, balances the right, the obligation and the benefit, take the judicial and the political way at the same time, and establish a neutral paty dispute settlement body for the China-Kazakhstan cooperation center. Only by these way can conform the development of the China-Kazakhstan cooperation center and the actual situation about the Cross-border cooperation in our country. |
