Study On The Human Rights Guarantee Issue In Preliminary Examination Of Duty Crime By Chinese Procuratorate Organs

In the modern society,strengthening human rights protection has become a popular tendency of the international community.For this aim,the international society and organizations have drawn up and signed a series of pacts and agreements,so as to promote the protection of human rights,particularly the protection of human rights in criminal litigation activities.With the continual social and economic development in China,in the progress of constructing and development of democratic and legal-ruled society,protecting human rights should become one of the important goals of implementing various systems in China.In recent years,there has been an increasing focus on the issue of human rights protection in the judicial program by the masses in Chinese society.The procuratorate institutions,the main body inspecting criminal cases at work,has formulated the criminal case preliminary inspection system as a litigation process to launch criminal litigation at work.Since there is a lack of clear legal reference in the preliminary inspection conducted by the procuratorate institution,part of the institutions replace "preliminary inspection" with "investigation",in its execution,there is a lack of unified regulation,and effective supervision of the preliminary inspection right,which prove not beneficial for the investigated people to obtain their due effective protection among other problems,exerting harmful influence on the justice and credibility of the judicial institutions to a certain degree.Therefore,a systematic research and discussion of the human right protection issue in the preliminary inspection of crimes at work not only exerts important realistic influence on the healthy development of the human right protection work in the progress of discovering career crime by the procuratorate institutions,but also bears positive significance in pushing forward the construction and perfection of the career criminal case inspection system in the future.The paper starts with the theoretical basis of human rights protection in the preliminary inspection of the career criminal cases,integrates the basic condition of the implementation of career criminal case preliminary inspection system in China in recent years,analyzes the issues of human right protection in the preliminary inspection of career crime preliminary inspection in the modern society,and integrates the current condition of supervision and inspection mechanism in China,so as to propose exploring strategies concerning the perfection of career crime preliminary system in the national supervision and inspection revolution from the perspective of human rights protection.
