At present,the crime of transporting drugs is one of the highest rates of exposed cases in judicial practice.Especially in Guangdong Province and Yunnan Province,the drug crime rate has been always kept high incidence and serious situation.It is well-known that the drug crime is harmful to the nation,the society and the public.Although the nation has been formulated and issued a series of the policies and judicial interpretations to control drug-related crimes,there are more and more new questions of transporting drug crime which need to be solved by judicial staff.With the development of science and technology,the drug crime has showed new features: the constant changes of crime means;the increase of organized crime;the enhancement of their anti-reconnaissance capability.This article illustrates three questions on the crime of transporting drugs with a real case in practice.Firstly,it is how to judge the connection of criminal intention in joint crime.In this part,the author demonstrates how to apply the presumption regulation to identification the connection of criminal intention in joint crime by illustrating the conception,features and regulations.Secondly,the author analyses the accomplished offense and the attempted of transporting drugs.Based on the agreement with the opinion of “begin to transport”,the author explains the rationality that the security door of the waiting room or in waiting room in the public station should be regarded as entering into the transportation areas “in process of the transportation”.Thirdly,the author expounds the reasons that it is not need to be on the spot in the process of identifying the photos by claiming meritorious service of “identification on the spot”.The author expects the article will be helpful for the judicial staff to deal with disputable questions of the transporting drugs crime in the future.
