As an industry,the lifeline of online games is innovation.Especially for game rules and game design innovations.However,in order to achieve profitability,some online game development companies simply copy the game rules of other games and then develop”clone games" so that they can greatly reduce the cost of game development.However,the prevalence of“skin-changing games”will inevitably lead game developers to become more obsessed with plagiarism than innovation.As a result,homogenous competition in the.market is serious.The reason for this phenomenon is that there are no clear rules for online games in China's copyright law.Coupled with the fact that China's relevant market has just been established,it is not yet mature and the supporting mechanisms in various aspects are not perfect.Therefore,this article will be divided into five parts,describing the problems faced by current online game rules and the solutions to problems that we can learn from.The first part is to sort out the relevant issues of the current online game rules in China.Explained the definition of online game rules and analyzed which type of online game rules should be protected by intellectual property law.Starting from reality,we analyzed the reasons for the plagiarism caused by the rules of online games in China.The second part discusses the protection of online game rules from the perspective of copyright law.Analyze the copyrightability of the game rules themselves.That is,online game rules actually have originality and reproducibility.Therefore,it can be protected as a work.Second,it lists the rules of the game that are not protected by copyright law.Then,a case was used to illustrate the current status of the protection of online game rules between China,the United States,and the United Kingdom,and made a corresponding analysis.The third part discusses the possibility of protecting the online game rules from the approach of the patent law,and lists the corresponding examples.In China,there is also a method of combining the game rules with the computer and packaging it into a technical solution.The way to protect.In addition,this chapter also lists relevant cases,and according to the cases we listed,we can analyze the types of online game rules that may be protected by patent law.The fourth chapter discusses the protection of online game rules from the unfair competition law approach.This section lists China's corresponding cases injudicial practice,and analyzes the advantages and disadvantages of using the principle clauses in the Anti-Unfair Competition Law to adjudicate cases.The fifth chapter puts forward the system concept of regulating the infringement phenomenon of online games.The first is to draw on advanced foreign programs and set up the type of works in the "copyright law" in China.And the overall protection of video games to achieve the purpose of protecting online game rules.Second,it can also introduce"statutory licensing" from the perspective of balanced distribution of benefits to achieve the goal of protecting gameplays and the interests of the game developers.
