Research On The Legal Regulation Of The Unfair Competition Behavior In Online Game Live Broadcast

In recent years,China's online game live broadcasting industry is booming,and various online game live broadcasting platforms are proliferating.However,with the rise and development of online game broadcast industry,the competition order in the industry is in chaos,such as operators' free-riding,false publicity and other unfair competition behaviors occur from time to time,and problems such as lack of legal regulations are also highlighted.Good competition order is the foundation of the live online gaming industry development,in view of this,it is necessary for our country network game live acts of unfair competition law in the study of rules and regulations,analyzes its present situation,points out its problems,and put forward the perfect network game live acts of unfair competition law in the regulation of feasible suggestions,in order to promote the healthy development of the live online gaming industry.This paper raises the problem,analysis the anti-unfair competition law in the applicability of the network game live,the acts of unfair competition in network game live body and carry out specific analysis on the types of acts of unfair competition,and then on the basis of the analysis of network game live in anti-unfair competition law regulation of the advantages and disadvantages,and put forward in the network game live,perfect the anti-unfair competition law applicable suggestions.The main body of this paper can be divided into four parts:The first part is the introduction part.This part puts forward the applicability of China's "anti-unfair competition law" in online game live broadcast.On the premise that there is no broad consensus on the regulation of online game live broadcast in the copyright law,the "anti-unfair competition law" is of great significance to the regulation of online game live broadcast.The second part analyzes the applicability of the law against unfair competition in network game broadcast.The "anti-unfair competition law" has its applicability in network game live broadcast.Meanwhile,this part analyzes the subjects of unfair competition in network game live broadcast and the types of unfair competition in network game live broadcast.The third part analyzes the advantages and disadvantages of the regulation of anti-unfaircompetition law in network game live broadcast.This part is an important part of this paper.On the basis of the second part,this paper puts forward the advantages and disadvantages of the regulation of anti-unfair competition law in online game broadcast.This part points out that the anti-unfair competition law has the advantages of making up for the defects of the regulation of the intellectual property law,the flexibility of its application,the regulation and guidance of the market,but in its application,there are also some problems such as the unclear application boundary of the intellectual property law,the application of general provisions and the insufficient protection of the anti-unfair competition law.The fourth part discusses the improvement of the application of "anti-unfair competition law" in network game live broadcast.On the basis of the problems proposed in the third part,such as unclear application boundary of intellectual property law,general provisions and insufficient protection of anti-unfair competition law,this part explores the improvement of the application of "anti-unfair competition law" in live online games.This part respectively from the clarity of the anti-unfair competition law and intellectual property relationship,promoting the applicable law of anti-unfair competition law and objectivated intensify protection of anti-unfair competition law regulation of three aspects put forward the targeted countermeasures and Suggestions,expecting to improve in the network game live "anti-unfair competition law" regulation,promote the healthy and orderly development of live online game industry.
