Study On The Renewal Of Residential Land Use Right In Our Country

In recent years,due to the high renewal fees due to some residential land use rights in Wenzhou,the land use permit can be handled,causing concern and hot discussion in all sectors of the society.For a few places where the right to use residential land has expired,the state has formulated a "two-in-one-normal" transitional approach.Article 149 of the “Property Law” of China specifically provides for the renewal of residential land use rights: If the period for the use of residential land for construction expires,it will be automatically renewed.There are no specific provisions on renewal such as whether fees are charged or not,the length of the renewal period,etc.The issue of the renewal of residential land use rights is a matter that affects hundreds of millions of families.This paper is mainly divided into four parts to discuss and analyze the issue of the renewal of residential land use rights in China.First of all,this article analyzes and summarizes the current status and historical overview of residential land use rights in China.Through a review of the existing provisions of the Constitution,the Property Law,the Land Administration Law of the People's Republic of China,and the Urban Real Estate Management Act for China's land use rights;secondly,the land use rights of the dynasties of our country's history are passed.The system was combed and analyzed.Secondly,this article summarizes a series of problems that have arisen from the renewal of China's residential land use rights.The main discussion point for the renewal of the residential land use rights shall be in terms of the renewal period,the number of renewal periods,whether the renewal is paid or not,and so on.Scholars have put forward their own views.Again,there are comparisons to identify.The third part summarizes and compares the issues related to the renewal of residential lands in major civil law countries and common law countries.Now that globalization has gradually taken shape,we are living on the same planet,and each country will inevitably influence each other.Therefore,it is necessary to compare and analyze the system of residential land use rights in Europe and the United States.Finally,there are some glimpses of the issue of the renewal of residential land use rights in China.It is necessary to improve the term of renewal of residential land use rights under the provisions of national laws,make the renewal fees universal,and the renewal procedure has the benefit of the people.China has a vast territory and a large population.The issue of the renewal of residential land use rights is of great concern.In order to solve this problem,we must not only consider the current state of economic development in our country,but also adjust measures to local conditions,analyze the situation of each family in different provinces and regions,and formulate strategies for each family.With the rapid development of science and technology in today's world,and the country's economic development is booming,it may not be easy to formulate a completely stable policy.It should be based on the people's interests,be conducive to the people's livelihood,and social harmony and stability.
