Problems And Measure Of Administrative Law Enforcement In Inland River Passage Under <The Passage Law Of PRC>

In December 28,2014,<The Passage Law of PRC> was formally adopted by the Standing Committee of the National People's Congress and officially started in March 2015,which marks a new step in the management of China's waterway.However,relative to the construction of other laws and regulations such as railway,highway,aviation and other laws of transportation systems,<The Passage Law of PRC> is relatively lagging behind,resulting in the related laws and regulations that have not been issued and many inconvenience to the passage management,and the effect of the aeronautical law is greatly reduced.Based on this background,this paper,taking the Ganjiang River passage management of Jiangxi Province as an example,analyzes the effectiveness of administrative law enforcement after the promulgation of <The Passage Law of PRC> and the problems of many black wharfs and serious illegal sand mining after the promulgation of the passage law,and analyzes its original causes.On this basis,the corresponding countermeasures are put forward.In order to improve the effect of passage administration,it is suggested to strengthen and improve the management of passage management by improving the legal system of the passage,optimizing the management function of the channel department,improving the level of the administrative law enforcement service of the passage and practicing the concept of service based law enforcement.
