The Study On Legal Issues Of Arctic Passage

The arctic passage is located in the Arctic Ocean and the Russia, Canada coastal states border. It is the shortest route between the northern Eurasia and North America, which across Europe, Asia and North America. Because of the thick ocean ice, after a certain segment of opened in the arctic, it is not concern for most countries. Along with the arctic channel is opened, countries around the world began to focus on the Arctic, which have strategies in place to ensure that its interests in the arctic, especially the arctic countries such as Russia, Canada and the United States. Therefore, in this paper, the arctic channel is the research object. And the writer makes every effort to provide suggestions to ensure our country participating in the Arctic Passage affairs.First of all, the geographical situation and the disputes on legal status of the arctic channel is presented in this paper.Then the writer proposed that the legal status of arctic passage should be based on the United Nations Convention on the Law of the Sea and the theories of the historic waters and international channel. The arctic channel is an international passage and it does not fall within the scope of coastal states which claim that the arctic passage is in the inland waters or territorial waters. Secondly, the relevant laws and policies to control the arctic passage of Russia and Canada were briefly introduced and summarized. Thus, our country is faced with the problems to use the arctic passage firms. At the last, the solutions are proposed to solve those challenges.Our country should strengthen the relationship with international organizations,and promote to establish the unified arctic legal system on the basis of the the United Nations Convention on the Law of the Sea. And should actively participate in international maritime legislation, strengthen the study of the Polar Code. In addition, in terms of technology, we should improve the ability of the construction of polar vessels in our country and the quality of training of polar sailing crew.
