The Exploration On The Protection Of The Network Privacy Right In China

The network privacy right is not an independent professional legal concept.It has derived complex new characteristics on the basis of the traditional privacy right.In recent years,the computer network system has developed rapidly.The personal privacy protection in cyberspace is facing a severe situation.The public and legislators pay more and more attention to the concept of the network privacy right,and the concept of the network privacy right becomes more and more popular.The author understands the connotation of the network privacy right by reading and consulting the datas,its protection related contents and the challenges,and gives some suggestions on how to improve the protection situation by combining with the situation of foreign countries.The full text is divided into five chapters:The first chapter introduces the basic connotation of the network privacy right.The definition of the core connotation of the traditional right of privacy is different in other countries and regions.In our country,the right of privacy is not established as a clear constitutional right.The derived right of network privacy is not only a right of personality,but also can attribute to property right.The torts are also difficult to define,and when the two rights are compared,the network privacy right also has its new characteristics.In the second chapter,the author studies the necessity of protecting the network privacy from the angle of the degree of network privacy.At the same time,it emphasizes the importance of protecting the degree of network privacy from the perspective of economics.The third chapter analyzes the challenges to the protection of network privacy right.The author enumerates the conflicts between the protection of network privacy and related rights and interests,as well as the serious social challenges to the infringement of network privacy right.On the one hand,the protection of network privacy right can not be ignored.On the other hand,it is difficult to protect the legal rights and interests of the public,The author enumerates and analyses one by one.Chapter 4th is an overseas investigation of the protection mode of network privacy right.The author compares the advantages and disadvantages of the two systems and gives comments on the advantages and disadvantages of the two systems,which are based on industry regulation in the United States and legislation in the European Union.Chapter 5th discusses the protection mode of network privacy in China.Through the analysis of Europe and the United States in the third chapter,the protection mode of network privacy in China is further analyzed.In this part,the author points out the necessity of perfecting the relevant aspects,and gives some suggestions on legislation,judicature and industry regulation.
