The instigator of detachment refers to joint crimes,in which the instigator automatically eliminates the criminal intentions,withdraws from the accomplices,and exerts sincere efforts to cut off the psychological causal relationship between the criminal result,but the crime accomplishment still occur.The research about instigator is a difficult problem in practice,and it should be studied on the theorical basic of the withdraw from the complicity and combining with the characteristics of itself.In this paper,it introduces the relevant theories of Japan,the country studies the instigator detachment most thorough at present,and puts forward own views.Through the comparative study of instigator related theory at home and abroad,it can be judged that the constituent elements of the instigator deatchment are mostly from the aspects of space-time,subjectivity,objectivity,etc.we usually judge whether the instigator detaches successfully by analysing the crime whether embarked on the resolution of behavior,psychological cause and effect,and whether the sincere efforts were given.In addition,based on the analysis of the conditions and standards of the instigator detachment,it briefly introduces the actual situation in which the different types of instigator detachment.There are different conditions for different types of abettor to be detached,it is should not be generalizations,whether a specific type of abettor is disconnected should be analyzed on the basis of specific cases.Some special types of instigator can not be separated from each other in principle,but they may still be divorced under certain conditions.The ultimate goal of the study of the instigator of detachment is to solve the problem of penalties for the instigator who has produced the result of the crime through the explanatory theory.The legal effects of the instigator of detachment generally include three kinds: the attempted guilty,the terminating guilty,and the discretionary punishing,and the concrete punished sentence needs to be comprehensively considered in stages,circumstances,and circumstances.In the criminal law of China,there is no relevant stipulation about the withdraw from the complicity which belongs to the exotic,and the relevant provisions of thesuspension are generally applied in judicial practice.The punishment rules,full responsibility for partial conduct,are too stringent for instigators who give up and run out of all the possible ways to stop the criminal consequences from happening,and contrary to the basic principle of crime punishment and the criminal policy of tempering justice with mercy.Therefore,our country should introduce the theory of the withdraw from the complicity and consider the instigator of detachment as a sub-concept of the withdraw from the complicity,and its introduction and application must combine the characteristics of our country's criminal law and the present judicial status.In Japan and Taiwan where the theoretical research of the withdraw from the complicity were studied most thorough,the penalties of the disengaged persons were not clearly stipulated in the provisions of the criminal law.Generally,they were appealed to theoretical doctrines or judicial precedent to solve the problem of imputation of the disengaged persons in judicial practice.This model has very important guiding significance and practical value for how to construct the punishment model for the instigator of detachment of our country.
