Construction Of Compound System Of Residual Rights Attribute In Exclusive Economic Zone

The issuance of United Nations Convention on the Law of the Sea(hereinafter called UNCLOS)terminates the time when maritime powers occupied ocean.The birth of UNCLOS provides a basic law framework and relatively fair standard for maritime activities.However,the countries have to compromise on some contradictions in order to quickly conclude UNCLOS,and they adopt package deal to achieve their goals,which leads to many defects of UNCLOS on regulations regarding residual rights distribution of exclusive economic zone.Over the years,the conflicts on resources development and utilization,maritime environment protection and military activity within exclusive economic zones have been escalating.Therefore,we take residual rights of exclusive economic zones as research object,briefly introduce emergence and development of residual rights within exclusive economic zones,take attribute classification and value analysis as the research point,define basic concepts of "attribute of the residual rights in the exclusive economic zone" and "attribute compounding".Through the analysis of political attributes and economic attributes in the exclusive economic issues,the significance of the compounding of attributes in the region to solve problems is described.By studying the residual rights of the traditional exclusive economic zone and summarizing the emerging problems under new horizons,we rationally explore the legal significance of the residual rights in the exclusive economic zone,as well as its emergence and development.The establishment of a settlement system of residual rights to the exclusive economy is indeed a general trend.It is a relatively sound approach to analyze residual rights in the exclusive economic zone in the principles of attribute compounding and green development.This diversified approach for analyzing problems further accords with the need of resolving disputes.By searching a large amount of information,the issue of the nature of the residual rights in the exclusive economic zone has been analyzed historically and legally.In addition,through various international cases,the connotation,value standards and related resolution principles of the exclusive economic zone are analyzed.We can learn the successful experience from the analysis of the EP-3 incidents and the development of fishery resources,etc..Through reading and searching a large number of academic works and periodical literature,we used empirical analysis,comparative analysis,historicalanalysis and other methods,and obtained a solution to the problem of residual rights in the exclusive economic zone.From the perspective of maintaining the peaceful development of the world's oceans and seas,all countries should comprehensively promote the development of the law of the sea,actively carry out diplomatic activities to promote the conclusion of regional treaties,and expand interpretations of the provisions of UNCLOS,etc.,and promote the establishment of systems using the compounding of residual rights attributes.It is hoped that all countries in the world can resolve the maritime disputes peacefully under the premise of respecting the original intention of the establishment of UNCLOS,gain more right to speak in the development of international oceans,and build world ocean powers.
