The market size of the online game industry is expanding,and it has become one of the fastest developing entertainment industries in the world.As the booming development of online game industry,unfair practices such as "reference","skin changing" and "free riding" have been banned repeatedly,and there is no perfect solution to these problems by judicial practice interface.In practice,online game copyright infringement cases occupy most of the cases of the infringement cases of online game intellectual property infringement,and the most common in this kind of infringement is copying or plagiarizing the game elements.These practices also obviously belong to the unfair competition behavior.The identification of the nature of the images of the online game makes a great impetus to solve the problems of online game living,online game piracy and other related problems.Firstly,based on analyzing the case of“MU vs Miracle Myth”,the paper has explained the concept of the images of online game and expounded that the images of the online game had the general characteristics of the objects of copyright protection with originality and replicability.Secondly,through the comparative of the compilation works,the genre films and the audiovisual works,the paper has concluded that it was more conducive to protect the online game screen as audiovisual works.Finally,based on the opportunity of revising the Copyright Law in China,drawing on the experience of foreign legislative and judicial practice,the paper suggests adding the concept of "audio-visual works" to the Copyright Law(Draft)to protect the images of online game.At the same time,we should strengthen the propaganda of "the idea of paying for intellectual property ".
