The Infringement Cognizance And Protection Of The Right Of Information Network Transmission

In today's era of high network popularity,the Internet has penetrated into all aspects of public life.On the one hand,the general application of network and the development of network technology make the public access to and use work more convenient,enhance communication and communication between people,on the other hand,it brings unprecedented challenges to the protection of the right to communication of information network.In judicial application and trial,the problem of infringement identification of information network transmission right has always been the focus of attention.In order to protect this right and its related rights and interests,the copyright law of the People's Republic of China was enacted and passed in 2001,which refers to the right of "the right of communication of information network" and the related concepts.Subsequently,the State Council enacted and passed the regulations on the protection of the right to communication of information network in 2006.The regulation was revised in 2013,and the protection of the right to spread the information network and its related rights and interests was more complete and specific.Although the protection of the right of information network dissemination is constantly increasing in the current law,there are still many problems in judicial application and trial.The number of cases about the right of information network communication is increasing in judicial application and trial,and the protection system about the right of information network communication needs to be further improved.This article first analyzes the concept of the right of information network communication,then expounds the identification of its tort,and introduces the right of information network communication and its tort.This paper also introduces the right of information network communication and the relevant regulations in the legal system abroad and in China,summarizes the shortcomings and problems existing in the relevant system of the right of communication of information network in China,and finally puts forward some suggestions on the problems.
