The Reform And Reconstruction Of The Collective Land Expropriation Procedure In Our Country

Following the promulgation and implementation of the Regulations on the Acquisition and Compensation of Buildings on State-owned Land,since there are no systematic legal documents that regulate the expropriation of rural collective land,the issue of rural collective land acquisition has gradually exposed many problems.In addition to the definition of public interest and the issue of compensation and resettlement,the internalization of the collection procedures has become the crux of the whole collection procedure's difficulty in achieving the legitimate interests of the expropriated person.To change the current expropriation procedure,it is necessary to reconstruct the current collective land expropriation procedure,remove the administrative dominance of the expropriation procedure on the basis of clearly defining the rights boundary of the rural collective land,expand the participation rights of the land expropriated farmers,and introduce judicial remedies.Effectively protect the rights of farmers whose land has been expropriated.The application of a specific construction project to start the collection process meets the requirements of due process and provides a good starting point for the solution of many problems in the requisitioned collection process.The division of the collective land acquisition procedure into several phases and the constrained exercise of rights in stages can solve the existing problems of the current procedure more reasonably.
