Problems And Improvement Of Collective Land Expropriation Procedure In China

In 2019,The amendment of the Land Management Law has further improved the land expropriation procedure.In 2020,We will comprehensively promote the reform of the land expropriation system.The reform of the land expropriation procedure is continuing.At present,the land expropriation procedure is still a hot issue concerned by academia and society.This paper mainly through cases and related news reports,to explore the implementation status of collective land expropriation procedures and summarize the existing problems of collective land expropriation procedures.The main problems are as follows: First,the procedural rights of land-expropriated farmers are not guaranteed;second,the subject of land expropriation procedures is not standardized;third,the Judicial relief channels of land expropriation are not smooth.On the basis of the problems found,this paper further analyzes the causes of the above problems,including the poor supervision of land expropriation administrative power,misplaced role of villagers' committee,and unreasonable design of land expropriation procedures.Finally,This paper tried to make the following suggestions.One of the solutions is to strengthen the supervision of land expropriation administrative power;the other is to strengthen the participant status of collective economic organizations;and the other is to optimize the design of land expropriation procedures.
