The Study Of The Legal Supervision Of The Urban Car Time-Sharing Rentals

Car time-sharing rentals as a new mode of transportation combining sharing economic and travel together,is an important part of the multi-level city public transportation system,which has played a positive role in personal travelling and the development of the city traffic system with its quickness,flexibility and efficiency.In our country,sharing the car sharing lease was born in 2011,and entered the golden period of development after 2015,which has developed only about 7 years.At present,the development of China's shared automobile timeshare industry and the government's supervision of the industry are still in the exploratory stage.The industry order needs to be established.The relevant regulatory system is in urgent need to be improved.The new format will bring great economic value and will also create new problems.However,the law is stable and lagging,and the targeted regulatory system is not updated in time.It is very difficult for the existing legal system to supervise the automobile timeshare effectively.At present,the problems existing on the supervision of the industry are: the lag of the supervision mode,the lack of the trust mechanism,the imperfection of the lessee identification mechanism,the loose of the safety responsibility system,etc.Combined with the above questions,this paper will investigate and analyze the development status and regulatory system of shared vehicle time-sharing lease in some foreign countries,and draw lessons from its mature regulatory experience,for example,adopting a responsive regulatory strategy in the establishment of the system,exploring a new path in the regulatory model,focusing on the construction of upstream and downstream supporting facilities.On the basis of fully analyzing the problems existing in the regulation of time-sharing leasing of shared vehicles in China,the successful experiences of foreign countries in the regulation of time-sharing leasing of automobiles are summarized and learned,which is beneficial to improve the level of the regulation of shared automobile time-sharing lease in China.This paper holds that to improve the level of supervision system,the legal goal should be to encourage innovation and ensure order.The overall benefit and fairness of the urban car rental market should be taken into account as well.In the specific system design,this paperputs forward the establishment of the safety responsibility system,the implementation of the lessee identification system,the establishment of the lease operator and lessee credit rating system,the innovation of the supervision mode,the establishment of the unified service platform of time-sharing lease,the improvement of the government-enterprise information sharing mechanism,the improvement of the insurance indemnity mechanism and so on.
