Research On Enterprises' Credit Supervision Legal System Under The Background Of Business Registration System Reform

Since the implementation of the reform of the industrial and commercial registration system,under the requirement of "easy entrance" reform,the government has been actively transforming its functions,streamlining administration and delegating power,and giving enterprises more initiative and autonomy in market activities.For the threshold for market access lowered,the number of newly registered enterprises has increased greatly,which has stimulated market vitality.However,this has also brought new challenges to the supervision of the enterprises.After the reform of the industrial and commercial registration system,it is urgent to construct and improve the enterprise supervision system that can effectively link up and match the reform of the business registration system,to ensure the current round of reform will stimulate market vitality and social creativity while providing a good legal and social environment for market participants to participate in market economy activities.In order to adapt to the new situation after the reform of business registration system,the government proposed to strengthen the credit constraints of enterprises,change the traditional administrative management mode,and establish a fair,open and transparent market regulation.Therefore,perfecting the system of enterprises' credit supervision in our country is a pressing matter to implement the “strict supervision”principle in the background of industrial and commercial registration reform.Based on the experience of other countries and the actual situation of our country,combined with the background of business registration system reform,we can make some suggestions for improving the legal system of enterprises' credit supervision in China.This article is divided into four parts,except the introduction and the conclusion.The first part is the system review and status analysis of China's enterprise credit supervision system under the background of the reform of the industrial and commercial registration system.First,the legal documents on corporate credit supervision related to the reform of the industrial and commercial registration system were combed.After that,the current status of China's enterprise credit information,credit rating supervision system,and corporate information disclosure system were analyzed.The second part is the analysis of the problem of China's enterprise credit supervision system under the background of the reform of the industrial and commercial registration system.In order to closely integrate the background of the reform of the industrial and commercial registration system,we must first proceed from the whole and analyze the existing problems in the legal system of credit supervision in existing enterprises in China.Then,in the aspects of corporate credit information,corporate credit information disclosure,and corporate credit rating,the company has in-depth analysis of the specific issues facing corporate credit supervision.The third part is the extraterritorial experience review of corporate credit supervision.Represented by the United States,the European Union,and Japan,it introduced the supervision and regulation system of extra-territorial enterprises from two aspects: the legal basis of corporate credit supervision system and the model of corporate credit supervision.Through inspecting the experience of corporate credit supervision outside the domain,we can inspire the perfection of the legal system of corporate credit supervision in our country.The fourth part is about the new problems faced by China's enterprise credit supervision under the background of the reform of the industrial and commercial registration system summarized in the second part,and puts forward suggestions for improving the legal system of corporate credit supervision in our country.In summary,it is first to establish a diversified credit supervision structure by clarifying corporate credit supervision departments and establish the overall framework of China's corporate credit supervision legal system.Secondly,by perfecting corporate credit supervision and matching laws and regulations and establishing a unified credit rating standard,the legal system for corporate credit supervision in our country has become more complete.By standardizing corporate information disclosure content,corporate credit information sharing has been achieved to solve the current corporate information disclosure system in China.Not a strong problem.From the general to the specific,establish and improve the legal system of corporate credit supervision in China,so that it is in line with the era background of the business registration system reform.
