The lack of guidance in electronic data preservation time in China and the slight legal consequences lead to more legal guidance and less compulsion,which makes it difficult to collect electronic data in China’s judicial practice.At the same time,in the identification of electronic data evidence,the current law using the hash value as the only method cannot verify the authenticity of the image electronic data evidence,and the lack of integrity of the identification system of electronic data cloud storage context leads to that the electronic data cloud storage of the original can not be verified.In addition,the lack of electronic data knowledge of judicial personnel leads to taking the identification and expert opinion instead of substantive trial.To solve these problems,it is necessary to extend the time for the preservation of electronic data and to aggravate the legal consequences of the preservation of electronic data at a specified time,to add the "perceived Hash" value as a criterion for judging the authenticity of the image data,to set up the identification mechanism of the evidence of the cloud storage electronic data and build the TTP system,and to strengthen the ability of judicial personnel to discriminate electronic evidence and play the role of the people’s assessors.
