The reform of the housing market started at the end of the 20th century promoted the rapid development of urban residential areas in China.The economic prosperity and advancement of science and technology have changed the way of life of residents.Various household appliances and electronic products are flooded in the lives of residents.Therefore,residents The higher reliability requirements and power safety requirements of urban residential districts have been raised.However,due to the lack of unified legal norms in the current supply and distribution facilities of urban residential quarters,the ownership of property rights is not clear,the main body of maintenance obligations is absent,and the procedures for tendering and bidding of supply and distribution facilities are not standardized,resulting in blackouts in urban residential areas.The frequent occurrence of security accidents has caused a large number of residents to make complaints,petitions and other malignant mass incidents.Due to the lack of unified legal regulations on the supply and distribution facilities of urban residential quarters,there are two different institutional arrangements on the supply,resulting in the indefinite ownership of property rights for the supply and distribution facilities of urban residential quarters,which in turn leads to the bidding Maintain the inconsistency of the main body of obligations.In this paper,a combination of field surveys and theoretical analysis is used to analyze the legal problems existing in the two different systems.Under the current "specialized system" implemented by all provinces and cities,the main body of bidding for the construction of power supply and distribution facilities in urban residential quarters,the ownership of property rights,and the main body of maintenance obligations are separated.The real estate developer is responsible for the bidding construction.The property rights are owned by all the owners.The property company is responsible for the management and maintenance.This system has many drawbacks.In addition,the "Power Supply and Use Regulations" and the "Property Management Regulations" as the same administrative regulations on the level stipulate that different mainstays of maintenance obligations make the maintenance of the compulsory subject matter absent.Under the "New Home Placement System",the power supply enterprises are responsible for the preliminary construction bidding and maintenance work in the later period.However,because of the excessively high fees,people are boycotting them.At present,many provinces and cities have tentatively implemented or canceled them directly.This paper analyzes the reasons for this situation and puts forward some suggestions based on the analysis.Through theoretical analysis,the supply and distribution facilities in urban residential communities are quasi-public goods.Therefore,if we want to fundamentally solve the above problems,we must proceed from its nature to the construction,ownership and maintenance of power supply and distribution facilities in urban residential communities.A unified legal system arrangement.On the one hand,relevant legal documents are unified,and the power supply and distribution facilities in the urban residential community are quasi-public goods.Therefore,property rights belong to the power supply enterprises,and the power supply companies undertake maintenance obligations.On the other hand,at the specific operational level,it is necessary to make uniform regulations for the tendering procedures and maintenance procedures for the construction of power supply and distribution facilities,improve the supervision system of the tendering system,and unify the legal provisions for the maintenance of the obligatory entities.
