With the rapid development of commercial housing, there are many types of corresponding supporting facilities. But the ownership of the facilities is unclear that easy to cause the interests of the disputes between owners, developers and other subjects. Under the existing legal framework and determination of supporting facilities of property right is fuzzy, we need to further clarify the ownership as the basis. By supporting facilities for accurate qualitative, positioning, and to review trade-off property recognition method, and detailed analysis, summarized typical regions of the country’s relevant local legislation, we put forward the purpose of construction as the ownership as the basis. Our foundation construction purposes as ownership dividing to state-owned land transfer contract and construction planning for construction purposes depending on the specific can draw a distinction between the ownership and supporting facilities correspondingly classified into owned by the government, owned by the owners and developers of all facilities. In construction purpose as the ownership decided that according to the specific apply, we choose a controversial large underground garage, civil air defense project and the underlying stilt floor as the research object, in order to reflect the applicable value of construction purpose.The research contents of this paper is divided into the following three parts:The first part mainly introduces the research object. Namely the research scope limited to first residential district, and accurate qualitative and positioning of the supporting facilities, to the situation of the ownership dispute of supporting facilities for a simple description, and expounds the bad influence of facing the ownership is unclear.The second part is the key part of the article. First review the current owners decided on the basis of existing in the theory or practice, and then put forward the division of ownership according to the purpose of-construction, corresponding ground supporting facilities to classification, divided into three major ownership and special facilities for the future study of the ownership theory foreshadowing.The third part in view of the special facilities (underground parking garage, civil air defense project and the underlying stilt floor), make a concrete analysis of ownership that argument based on the ownership construction purpose according to carry on the corresponding ownership.
