Foster care is an important way of alternative family care.Foster care in China started relatively late,and a legal system of foster care,aiming to ensure the best interest of child,has not yet been established.Government is absent in foster care,scope of foster care is limited,support and protection for foster parents and their families is insufficient,assessment procedures and supervision procedures is not effective,the connection of foster care and other child protection methods is difficult,the support of older foster children is not enough.There is about 100,000 orphans(including abandoned children)are cared in institutions.From 2015 to 2016,fewer than 10,000 children were adopted,and more than 10,000 but less than 20,000 children in foster families.There are many children live in institutions and can't enjoy the environment of family.At the same time,many children in birth families need to be protected by reason of sickness,death,incompetency,improper guardianship,abuse or neglect on the part of their parents or other guardians.But,many of them don't have access to a foster family and their safety,health,residence,education is dangerous.The United Kingdom and America were the earliest countries to develop foster care.After years of development,they have formulated comprehensive and detailed legislation and established an effective legal system of foster care.This study is to analysis the development in our country,and to give some suggestions on improving the legal system of foste r care in our country via learning the experience in the United Kingdom and America.
