The Problems And Countermeasures Of The Post Evaluation System Of Local Legislation In China

After the reform and opening up,our country,in order to connect with the domestic and foreign countries as soon as possible,the fountain type legislation,has quickly formulated a lot of laws and administrative laws and regulations.The fountain type legislation has solved the urgent need of China,but there will be a lot of problems in practice.In spite of the revocation mechanism in our country,the revocation mechanism is in reality.It has never been applied.The imperfection of the revocation mechanism leads to many laws and regulations that are not too adaptable to the society.This makes it urgent for us to assess the post legislative evaluation.On the basis of the research on the implementation of the Guilin and Guizhou Province,we have summed up the existing problems in the post evaluation of the local legislation in China.It also opens the research strategy of this paper,that is,studying the experience of foreign countries,and then aiming at the local universal problems in Guizhou and Guilin,and finding out some more targeted solutions.The first chapter is the introduction,briefly introduces the basic content of the local post-legislative evaluation system,including its legislative background,research ideas,research purposes and domestic and foreign scholars on the post-legislative evaluation system research status.The second chapter is the important value and theoretical basis of local post-legislative evaluation,which is summarized from the following aspects: systematically summarizes the concept of local post-legislative evaluation;The characteristics of scientific means and legal timeliness;theory,practical needs,legal basis and the value of local legislation post-evaluation,to show the necessity and urgency of local legislation post-evaluation.The third chapter is through the domestic legislation post-evaluation legal provisions and the implementation present situation description,unifies Guilin and Guizhou after the legislation appraisal method concrete content,proposed our country local legislation post-evaluation and the appraisal non-normal.The evaluation organization is single,the evaluation standard is not clear and the evaluation result is not enough.The fourth chapter is a review of the extraterritorial post-legislative assessment system and the significance of reference,mainly from Germany,Japan,South Korea,the United Kingdom and the United States to introduce each country's specific post-legislative assessment system.Then summing up the foreign countries after legislation to evaluate the advantages of this aspect is worthy of our reference.The fifth chapter is to further improve the post-legislative evaluation system from the norm of evaluation,determine the evaluation criteria and the evaluation results should be used to put forward specific solutions.Through perfecting the problems of local post-legislative evaluation,it provides rich practical experience for our country to perfect the post-legislative evaluation system,meanwhile,through scientific post-legislative evaluation,we can also make legislative decisions for our country.Improving the quality of legislation has played a very important role.
