Research On Post-legislation Evaluation System In China

“As an old saying goes”,it is necessary to have effective tools to do good work. Lawmakers pursue the perfect legal system all the time and try their best to realize the harmony between the legislation system and its social effects. In recent years, in order to come closer to this legislation target, legislative subjects of all over the word established evaluation systems to improve the quality of legislation. In China, post-enactment evaluation is a new emerging term. In 2004, the State Council implemented the Enforcement Outline of Completely Advancing Administration According to Law, in which first time proclaimed China's post-enactment evaluation system on central files. However, we still need a complete post-enactment evaluation system to promote the development of legal systems. Nowadays,subject of evaluation mode, stakeholder mode and cost-effectiveness analysis mode are all adopted into China's post-enactment evaluation system. But these modes also show some problems. Based on the China's national conditions, the thesis will provide a few feasible suggestions to solve these problems, in terms of evaluation subjects, evaluation objects, respond mechanisms and so on.
