Legal Theory Research Of The Legalization Of Euthanasia

In terms of personal rights,the right to life is the supreme right.However,in reality,people cannot fully grasp the right to life because they cannot reject birth.Similarly,they cannot control death.However,with the continuous development of science and technology,people are constantly arguing about issues regarding death,of which the euthanasia is the focus.In order to figure out the question of euthanasia effectively and make a reasonable regulation,this article make the special research to the question of the legalization of euthanasia and discuss this question by means of comparative analysis and examples.For each individual,living and death are inevitable parts of life.Therefore,there are different opinions on the issue of euthanasia,namely,whether people can freely choose to give up the right to life.Compared with foreign countries,China’s study of euthanasia started relatively late,and Chinese people’s understanding of euthanasia is not deep enough.However,as China is a populous country in the world,euthanasia is an unavoidable issue.Therefore,it is of great theoretical and practical value to conduct in-depth research on euthanasia.This paper mainly studies the legal issues of the legalization of euthanasia from the following aspects: at first,starting with the concept of euthanasia,this paper explores the origin of the controversy over euthanasia,and on this basis,sorts out and comments on the arguments supporting and opposing the legalization of euthanasia.Secondly,a theoretical analysis is conducted on issues regarding euthanasia based on the ethical foundation,the human rights foundation,and the realistic basis of the legalization of euthanasia,and the legitimacy of euthanasia is demonstrated.Thirdly,combining China’s specific national conditions and reality,this paper investigates the basic status of euthanasia in China,and explores the main obstacles to the legalization of euthanasia in China in terms of ethics,medical conditions,and the legal environment.Finally,this paper attempts to establish the basic legislative construction of the legalization of euthanasia in China from the legislative principles of euthanasia,the conditions for the application of euthanasia,the procedures of implementing euthanasia,and the related legal responsibilities for euthanasia.Inconclusion,the question of euthanasia have the legal basis no matter from the aspects of ethics,human rights or realistic foundation,in the meantime,the legalization of euthanasia is not only in accordance with the specific national conditions of our country,but also widely accepted by other countries.Consequently,the legalization of euthanasia is bound to be the trend for China and the world today.
