Research On Procedural Issues In Party Legislation

The Fourth Plenary Session of the 18 th Party Congress held in 2014 was added to the socialist rule of law system with Chinese characteristics,and a new era for the construction of the party's internal legal system was started.Perfecting the system of the party's internal laws and regulations must first of all improve its intrinsic logical starting point,that is,the formulation of the party's internal laws and regulations.The improvement of the formulation of the party's internal laws and regulations cannot be done without the optimization of the party's internal rules and regulations.The procedure for the formulation of intra-party laws and regulations is theoretically a guarantee mechanism for the realization of democracy and the rule of law within the party.In practice,the development of a large number of laws and regulations in the party needs to be carried out in accordance with established procedures,showing the necessity and urgency of perfecting it.At present,there are many general and ambiguous points concerning the relevant provisions of the party's internal lawmaking procedures,which makes it difficult to establish procedures for use in practice.This article focuses on this,and after studying the procedures for the development of the party's laws and regulations through the use of literature research methods and value analysis methods,it is considered that:First,the problems existing in the process of formulating laws within the party should be systematically studied.After combing studies,it was found that there were problems in the formulation of opinions,drafting,deliberation,approval,and release of the procedures for the formulation of laws in the party.The procedures have not yet been incorporated into the process of establishing party rules and regulations.In addition,there are problems with the systems for reviewing,clearing,and assessing records that are closely related to the procedures for the formulation of laws within the party.,Secondly,it is necessary to put forward effective solutions to the problems existing in the procedures for the establishment of the party's laws and regulations in light of the party's practical experience and the mature experience of the legislative process.If voting procedures are included in theprocess of establishing the procedures,with a view to improving the quality of the party's laws and regulations,an exploration will be made for the institutionalization of the party's laws and regulations,procedural construction,and even the institutionalization and procedural construction of the rule of law in China.
