Research On The Executive Power Of The Internal Laws And Regulations Of The Communist Party Of China

With the Communist Party of China's(CPC's)transforming from a revolutionary party to one in power and consolidating its governing status,party laws and regulations have gotten a growing significance.Thus,people notice the implementation capacity related to party laws and regulations as well,and the awareness about that is becoming stronger and stronger.From the Eighteenth CPC National Congress,it is the emphasis on implementation capacity of party laws and regulations that provides legal support for an overwhelming trend on anti-corruption.The notion that those who break regulations must be prosecuted and regulations must be implemented strictly is becoming the common belief for the whole party step by step.This dissertation is based on reality and is composed by methods of system analysis,historical analysis and case study,also it could be divided into three parts.In the first part,we will discuss the concept of party laws and regulations and then define the meaning of implementation capacity of party laws and regulations.Consequently,we will investigate those five factors that could exert impact on it,which are party laws and regulations themselves,subject that implement party laws and regulations,object that party laws and regulations point to,the process and circumstance of implementation of party laws and regulations.In addition,the implementation capacity should be done with purpose in a single direction,also it is mandatory and flexible in a specific time and could be used repeatedly.All above feature the implementation capacity.In the second part,we will analysis problems in the process of implementation,such as apathy,carelessness,random choice and misunderstanding by design.Then we can attribute them to mutation of those five factors mentioned above.In the third part,we will give targeted advice to the solution of problems.We can perfect the system of party laws and regulations,improve capacity of implementation of the Committee of discipline inspection,gain identification of those party laws and regulations pointing to,consummate the system of safeguard and build healthy culture for implementation.Finally,the dissertation hold the opinion that only we never stop striving for the perfection of implementation capacity of party laws and regulations,can our party become more and more legal.
