Research On The Legal And Ethical Relations Behind Homosexual Marriage

In recent years,homosexuals have formed a group with a certain number and size in society.All countries in the world have imposed homosexual "marriage" on the gay community.Under the development of mutual promotion of law and ethics,the legalization of same-sex "marriage" is no longer a topic far away from our lives.When we face the issue of homosexuality,we dare to pursue and explore the ways of legalizing homosexual marriage.It is already legal and The product of continuous development of culture.Some western countries and regions have already recognized the existence of homosexual groups,and they have established an exclusive model of gay marriage in legislation.This has significant implications for our country.The struggle of homosexuals to fight for their equal rights and matrimonial rights has made it inevitable that countries have become an important legal issue.In China,the problem of homosexuality has existed for a long time.However,it is still a blind spot in the law so far.At present,Chinese scholars are also fiercely discussing how to legalize gay marriage.This article attempts to interpret the legalization of gay marriage from the perspective of the relationship between law and ethics in the perspective of jurisprudence.First,it reviews the development of homosexuality and homosexual "marriage," and the current state of homosexuality in China.It also describes the reality of gay and homosexual "marriage."Second,by summarizing the homosexuality and same-sex “marriage” phenomenon,we found that homosexuality and homosexual “marriage” are historically not accepted by ethics and law.Same-sex sexual behavior is discussed separately from homosexual "marriage." Because in the vision of ethics,sex and marriage are two different behaviors,and they have different moral standards.Same-sex sexual behavior embodies two properties—freedom and desire.In a certain ethical ecological structure,homosexual behavior will be affirmed by ethic as long as freedom and desire are accepted;however,marriage is based on the basis of population production and on human beings.The system of fertility norms,same-sex marriage can not escape the moral negation of birth standards in any society.The legal adjustment of homosexuality can only be unmarried.Thirdly,according to the Western society's legalization of same-sex “marriage”,we analyze the reasons why same-sex behavior is accepted and tolerated by social ethics,and at the same time analyze the factors that homosexual “marriage” cannot be legalized in our country.Finally,by exploring the laws and ethics behind same-sex sexuality and same-sex "marriage",same-sex sexual behavior accepted by ethics should be protected by law.For homosexual “marriage” that is not accepted by ethics,it is conceived that China should establish new legal relationships and adjust them.
