Research On Legalization Of Scientific And Technological Ethics

While the development of high and new technology promotes the progress of social productivity,it also brings many challenges.The "gene editing baby" incident has triggered a heated discussion on ethics and legal regulations,the ethics of science and technology has become a hot topic.Science and technology ethics is the theory and code of conduct of the relationship between people,society and ecological in science and technology activities,which stipulates the values,responsibilities and behavior standards that the science and technology community should abide by,respect,utilitarianism,justice and responsible research and innovation are its core principles.It discussed the necessity of the legalization of scientific and technological ethics from the self-discipline regulation anomie and the endogenous demand,combined with the socialization of responsibility and the complexity of science and technology management activities,discussed the feasibility of the scientific and technological ethics legalization from legal basis of the dialectical relationship between science and technology,ethics and law,as well as human dignity,juridical practice,national policy and the existing legal system.In the current legislation system of scientific and technological ethics,there are many problems such as low level of effectiveness,single normative field,varying degrees of legal transformation of ethics,direct transformation and mismatching of rights and responsibilities setting,The standardized development of the current management system is also delayed due to its own optimization problems and supervision defects.After exploring the ethical governance activities of United Nations Educational,Scientific and Cultural Organization and part of the country's ethics legislation practice experience,it suggested that China should pay attention to legislation in the field of science and technology ethics,narrow the gap of scientific and technological ethics legislation in various fields and the legal transformation degree of each ethics,adjust the technical means,and make a proper division of rights and responsibilities.Then a scientific ethical review system of science and technology should be established,including the development of the system itself and the improvement of supervision laws,so as to explore a sustainable common governance system of science and technology ethics.
