Research On The Legal Regulation Of Temptation Investigation In China

In the current social situation in our country,temptation investigation as a special means of detection,its legal status has been relatively vague,and with the people's life and the development of science and technology,more and more new forms of crime,the crime concealment and complexity of brought serious challenges to the investigation organ,rely solely on traditional detection methods have been difficult to cope with these special criminal cases,temptation investigation both from the investigation efficiency and their features can be well make up the flaw and the insufficiency of traditional detection methods,detection of suspected crime,realize the balance of efficiency and justice.The paper has four parts,the first has been clear about the definition and characteristics of temptation investigation,from the basic theory on the stated that in the temptation investigation means that the optimal benign and profitability at the same time,analyzes the various types of this kind of means and their characteristic;Secondly,the second part explains the existing laws and defects of China's temptation investigation system.Then,in the third part,the relevant legislation of foreign countries is introduced and analyzed.Finally,based on temptation investigation system in our country's current law and defects,in the case of draw lessons from other countries relevant system design,how to establish the temptation investigation system in our country,how to built the perfect legal mechanism,and promote the legalization process is the key to this study.Although the temptation investigation is still controversial,many differences exist in the educational world,however,this measure was investigation organ is widely used in the judicial practice,and its excellent effect is obvious to all.So,I think a general acceptance and use of,an effective means of detection,deserves its corresponding legal status,for the status of the blank in the legislation,it should be perfect legal regulation,only in this way,using this technique to realize the legalization of investigation,promote our country's legal processes.
