Research Into The Marriage Customary Law Of Longlin Yi Ethnic Group

Marriage customary law for minorities is an important part of China’s national law.It directly reflects the lives of the local people.It is the concentration of the local customary law,the integral part of social culture and an important manifestation of its own culture.As a source of law,in-depth understanding and guidance of its adaptation to national laws is of great significance for building a mature socialist legal system and promoting the sound development of society.According to the structure of the article,the focus of this paper is as follows:(1)The accurate description of the Marriage habits of the Longlin Yi ethnic group is the basic chapter of this article.(2)Studying the relationship between the marriage customary law of the Longlin Yi ethnic group and the national law,and integrating the research objects into the framework of legal theory for analysis.(3)Exploring how to connect the Longlin Yi ethnic group marriage customary law with the national law and give feasible theoretical measures.Specifically,this article has four parts.The first section briefly introduced the profile of the Longlin Yi ethnic group,including the location of Longlin and the ethnic origin of the Longlin Yi ethnic group.The second part mainly introduces some historically existing principles of the Longlin Yi ethnic group customary marriage law.These include the cousinship and levirate marriage;These are the principle parts of the customary law of the Longlin Yi ethnic group.The third part introduced the details of the marriage process of the Longlin Yi ethnic group,and gave a detailed analysis of marriage anddivorce.The fourth part deals with the relationship between the customary law of marriage in Longlin and the national law,and provides a concrete and feasible path for how to promote the interaction and coordination between customary law and national law.It is hoped that through the study of the marriage customary law of the Longlin Yi ethnic group,the writer will profoundly understand the common law of Yi ethnic group marriage from the perspective of law,present to the world the content of the colorful marriage customary law of the Longlin Yi ethnic group,and make a modest contribution to sum up the experience of the legal system construction in the Yi ethnic group and to improve the modern rule of law system.
