| The Jing ethnic group is one of the ethnic minorities in China,and is also a native ethnic group in Guangxi Zhuang Autonomous Region.It mainly lives in Wutou,Shanxin and wanwei islands in Jiangping Town,Dongxing City.These three islands are also commonly known as "three islands of Jing Ethnic group".Jing people live on the sea,also known as the sea people.In order to maintain the living environment,reasonably distribute production and living resources,and maintain social stability in the Jing area,the people of Jing ethnic group have formed their own unique customary law.The common law of the Jing ethnic group exists in the social organizations of the Jing ethnic group.It is manifested in various forms,and has a fixed place for implementation.It is not formulated or recognized by the state.It has external coercive force to ensure its implementation and coexists with the national law.These customary laws have played a positive role in the production,life and social stability of the Jing people,and are still of value.The author studies the common law of the Jing ethnic group and chooses wanwei Island,one of the three islands of the Jing ethnic group,as the place for field investigation.The reason is that there is only one administrative village in the island,including three natural villages: Wandong,Wanxi and wanwei,and the three villages are relatively concentrated and convenient for field investigation;the residents of the island are mainly of Jing ethnic group,accounting for 95% of the total population of the island,with the characteristics of Jing ethnic group;there are a large number of historical materials on customary law in the island.This paper is mainly divided into four parts,research and analyze themanifestation,key content and operation mode of Jing customary law.The purpose is to excavate the modern value of Jing customary law,promote the integration of Jing customary law and state,better maintain social stability and create a harmonious social atmosphere.The introduction part introduces the social background and significance of the study of Jing customary law,as well as the research ideas and methods.This paper summarizes and analyzes the current situation of the research on Jing ethnic group and its customary law,and finds out the deficiencies of the research on the common law of the Jing ethnic group,which is supplemented by this paper.The main content of the first chapter is the basic connotation and formation reasons of Jing customary law.It briefly introduces the origin and name of Jing ethnic group,and then discusses the economic and natural conditions of wanwei island to reveal the causes of the formation of Jing customary law.In the last part of this chapter,it expounds three main forms of the common law of the Jing ethnic group,including the forbidden regulations of the Jing ethnic group,the regulations of the huting Pavilion and the contract,among which the prohibition regulations of the Jing ethnic group are the main forms.The second chapter is the core content of this paper.It mainly studies the contents of the common law of the Jing ethnic group,including the social organization,marriage,sacrifice,production and life,property protection and other systems.With Weng village organization as the core,the customary law of Jing ethnic group is the authority within Jing ethnic group,which performs the responsibilities of formulation and implementation of Jing customary law,management of village affairs,mediation of disputes,management of rural drinking books,etc.When introducing the contents,the main customary laws of wanwei island are classified naturally,including social organization,marriage system,sacrifice system,property protection system,etc.The third chapter discusses how to implement the common law of the Jing ethnic group.This chapter includes two parts.The first part discusses the authority of the implementation of the common law of the Jing ethnic group.The authority mainly includes the worship of gods,the worship of nature and the authority of the organization.The second part discusses the specific procedures of the implementation of the common law of the Jing ethnic group,from the discovery of disputes to thesettlement of disputes and solutions.The fourth chapter discusses the plight and modern value of the Jing customary law.The customary law of the Jing ethnic group has existed for more than 500 years in the Jing ethnic group area.Due to the economic development,social changes and the infiltration of the national law,it has an impact on the common law of the Jing ethnic group.However,the customary law of the Jing ethnic group is endogenous and plays an important role in the development of the region.We should respect,adopt,confirm and carry forward the common law of Jing ethnic group,explore its own value and serve the construction of beautiful China,especially in the construction of beautiful countryside in the border areas. |
