Studying The Recognition And Enforcement Of Foreign AD HOC Arbitration Awards In China

China has always attached great importance to the recognition and enforcement of foreign arbitral awards.Although has not yet established Ad Hoc Arbitration System,in practice,Many foreign ad hoc arbitration awards are still recognized and enforced in China.Based on practical cases,this paper analyzes the status quo of recognition and enforcement of foreign ad hoc arbitration awards in China and the disputes arising from them,and give suggestions to the problems.The first part first discusses the standards of foreign ad hoc arbitration awards and the legal basis for the recognition and enforcement of foreign ad hoc arbitration awards in China.The second part analyzes and summarizes the status of recognition and enforcement of foreign ad hoc arbitration awards in China through statistical analysis.Through form I discover The Chinese Law has not set up ad hoc arbitration system,and has not stipulate "foreign arbitration awards ",Internal Reporting System is also incomplete,these cause some problems in the theory and practice of recognition and enforcement of foreign ad hoc arbitration awards._The third part analyzes the reasons why Chinese courts refuse to recognize and enforce foreign ad hoc arbitration awards.The last part puts forward suggestions,China should clarify the Standards of "Foreign Arbitral Awards",accept of "The Seat Of Arbitration Standard",and should establish Ad Hoc Arbitration System,and further perfect the Internal Reporting System.
