| Defamation of criminal activities threatens public security,disrupts normal social order,and has a tremendous impact on the right of social citizens and the exercise of their sexual freedom.For the crime of defamation,the Chinese mainland and the Taiwan region have separately formulated corresponding laws to contain this phenomenon.However,in general,the legislative system for crimes in defamation in Taiwan in China is more complete.At the same time,there are corresponding delinquency standards and criminal judgments for different social phenomena,especially the definitive definition of crimes and the identification of criminal subjects.There are many differences in various aspects such as punishment and punishment.Therefore,this article will proceed from different perspectives and discuss in depth the differences between legal protections and constitutive elements of defamation crimes on both sides of the Taiwan Straits in an attempt to clarify the criteria for distinction between this crime and another crime in Taiwan’ s defamation-related crimes,with a view to reducing mainland practices’ The ambiguous or controversial issue of crimes,and the proposal of amendments to the direction of possible amendments to the law,are the motivation for the study of this topic.This article is divided into three parts:the preface,the main text,and the conclusion.The first chapter of the text analyzes the legislative evolution of cross-Strait crimes and compares their legislative models.The second chapter is the most typical constitutional element of crimes of self-defeating crimes.The relevant content makes an exposition,deducing the difficulty of application of the current law in mainland China,and at the same time highlighting the differences between the crimes of defamation and the constitutional elements in the Taiwan region and the mainland,such as the concept of defamation and the handling of consequential offenses.The third chapter focuses on the differences between the cross-strait legislation proposed in Chapter 2 and the related disputes,supplemented by the present analysis and practical opinions of the mainland society,and draws conclusions and amendments to the amendments.Legislation. |
