A Study On The Legal Problems Of Personal Injury During The Reemployment Of Retired Persons In China

With the advent of the global "silver wave",due to the large population base and unbalanced economic development,China has entered the social development process of "not rich first" in advance.With an aging population,our country not only lead to the number of retirees increases year by year,social endowment burden,also prompted retirement again obtain employment personnel-the rise of the special labor group,which caused a series of legal problems about retiree employment.Because of the social background,the needs of employers and workers'retirement,retirees,chose to continue the employment,but limits the legal protection of labor rights in our country,many retirees during work because no effective relief working caused personal injury,leave hidden trouble in retirement life on employment,economic development and stability of the country.Therefore,how to solve the problem of personal injury caused by working is the focus of this paper.In this paper,through the introduction of the basic theory of retired personnel again obtain employment,the analysis of current retirees labor rights protection in our country from different value status of the legal system,combined with national conditions to enumerate the personal injury during the retirees reemployment relief problems,put forward feasibility suggestions to solving the conform to the judicial practice.
