On January 1st,2018,the revised "Unfair Competition Law" was formally implemented.As China's market economy continues to accelerate,all kinds of unfair competition behaviors emerge in an endless stream.Commercial bribery is a common operator illegal behavior under market misalignment and belongs to unfair competition behavior of the operator.On the basis of accelerating marketization,diversification of economic components,and diversification of interest subjects,commercial bribery has become a "magic weapon"for many companies to win more room for development,but it has also become a major issue in the market economy.In reality,the misidentification of commercial bribery has caused great harm to society.Therefore,only by correctly identifying commercial bribery and comprehensively regulating it can we better alleviate the task of anti-corruption and win the market environment and win the trust of other law-abiding subjects in the market environment.Under the background of the revision of the Anti-Unfair Competition Law,This article mainly analyzes the issues of subjects,subjective aspects,behaviors,and legislation and law enforcement in commercial bribery.The first part of the paper explains the severity of domestic commercial bribery through the use of commercial bribery data and related cases over the years.The second part is to analyze the legal changes in the subject of commercial bribery.The third part mainly analyzes the problems existing in the constituent elements of commercial bribery from subjective aspects and specific measures.The fourth part analyzes the issues related to the practice of commercial bribery in China as the object of the application between commercial law enforcement agencies and related laws.The fifth part analyzes the identification and regulation experience of foreign related commercial bribery;the sixth part is the suggestion to further improve the identification and regulation of commercial bribery in China.
