At present,80%of food is from agricultural products.The issue of safety of edible agricultural products concerns the immediate interests of every consumer and is also the most important part of the current people's livelihood issue.As an important part of the food safety supervision system,the establishment of a food product traceability legal system is not only beneficial to the improvement of food safety management standards,brand competitiveness,and consumer rights,but also strengthens the government's supervisory capabilities.Food quality and safety,fulfill government responsibilities.However,through the analysis of the traceability of the pilot work in practice and the laws and regulations of our country on the traceability system of edible agricultural products,we can see that the traceability system of China's edible agricultural products lacks national uniform and full-coverage traceability regulations at the national level,resulting in the practice process.There has been an over-retrospective legal system,lack of standardization and operability,and weak incentives for retroactive entities,which has,to a certain extent,inhibited the enthusiasm of participants in retroactive system construction.The regulatory model of "mainly based on variety supervision" is insufficient and lacks market participants,which makes it difficult to implement the law.The retrospective coding system,traceability standard,and traceability information platform for retrospective measures still need to be improved in terms of unity.Current measures the system has caused the management and inquiry of traceability information to be hindered.At the same time,the responsibilities for breaching the traceability obligation of food products are not strict and clear,and there is no mandatory enforcement to ensure the retroactive implementation of the traceability system.As a result,the traceability system of edible agricultural products has not produced the desired results.In view of this,this article starts from the legal system of edible agricultural products in China.Taking the current situation of the legal system of traceability of edible agricultural products in China as the basis for research.Through the use of literature research methods and comparative research methods to analyze the problems in the operation of the system and the successful experience of the EU,the United States,Japan's quality and safety retrospective legal system of edible agricultural products.Finally,it puts forward the feasible suggestions for improving China's relevant legal systems.In the following process of building a traceability legal system for edible agricultural products,we should combine the useful experience of developed countries with the specific national conditions of China,improve the current legislation for the traceability system of edible agricultural products,standardize the traceability supervision policy for edible agricultural products,and improve traceability measures for edible agricultural products,optimize the traceability of legal liabilities.We will further improve the legal system for traceability of China's edible agricultural products,safeguard the quality and safety of edible agricultural products,and safeguard the legitimate rights and interests of consumers.
